Commercial Account Terms and Conditions
1. Definitions
(a) Irrespective of the date of order all products supplied are chargeable at the price ruling on the day of delivery.
(b) The Buyer is responsible for providing safe and suitable Bulk Storage and associated filling and ancillary equipment which complies in all respects with all relevant requirements of and/or regulations, made to the competent authority and for ensuring that it will take the full quantity ordered. The Buyer shall also indemnify the Seller against any damages, injuries, claims, expenses, or costs of any kind whatsoever arising as a result of the Buyer not observing these conditions.
(c) The Seller will effect delivery by a connecting hose laid through the premises of the Buyer on the condition that the Buyer thereby indemnifies the seller against any loss or damage to the premises or its contents as a result of spillage or rupture of the hose.
(d) It is a condition of every bulk sale through hose that the quantity shown by the Seller’s tank wagon dip rod or other measuring devices employed by the Seller shall be accepted by the Buyer as the quantity delivered, but the Buyer may be represented at the taking of these measurements to verify them if he so desires; the Seller cannot accept any responsibility whatsoever or discrepancies in the Buyer’s tank, dip rods or other measuring devices. If on any delivery the Buyer or any representative of the Buyer, whether or not for the purpose of verifying the Sellers’ measurement of quantity for that delivery, mounts any tank wagon used on that delivery the buyer or his representative (as the case may be) shall do so at his own risk and the Seller accepts no responsibility whatsoever therefore.
(e) The Seller shall not accept liability for any change in the quantity of the product after delivery has been affected arising from unsuitability of the Buyer’s storage/handling facilities.
(f) The Deposits charged on returnable Packages which remain the Seller’s property and due for payment with the account and will be credited in full on their return in good condition carriage paid. Other packages on which no deposit is charged are free and non-returnable. In the event of the Buyer failing to return the Seller’s packages, the Buyer will in addition to forfeiture of the deposits, be liable for payment to the Seller of value Added Tax at the rate applicable at law.
(g) Prices are inclusive of Customs/Excise duty (if any) at the appropriate rate and any variation of duty at any time is for the Buyer’s account.
(h) Value Added Tax which is shown separately on the Seller’s invoices is in addition to the Seller’s price of the goods.
(i) Upon delivery of the products the risk shall pass to the buyer who shall be responsible thereafter for any loss in or damage to the products. Notwithstanding this the property in the products shall not pass to the Buyer until all outstanding sums due by the Buyer to the Seller have been paid. In the interim the Buyer shall hold the products and the process of sale of the products in trust for the Seller. If the Buyer fails to make payment of sums when due, the Seller may without further notice enter upon the Buyer’s premises and remove forthwith the products delivered and in respect of the Buyer has failed to make payment.
(j) The Buyer hereby agrees with the Seller strictly to observe all the conditions of the Buyer’s Petroleum Storage License and not to allow any smoking or naked lights nor permit any stoves, electric or gas fires or radiators or any other naked flame, to function in proximity to a tank or inlet pipe into which a delivery is being made or a vent pipe connected to such tank and will indemnify the Seller against any damages, injuries, claims or costs arising out of the breach of this condition.
2. Payment Terms
(a) Payment terms are strictly 30 days from invoice date, unless otherwise agreed in writing. If payment is not made within 14 days of being due the Buyer shall pay to the Seller interest on outstanding sums at the rate of 2.5% per month until payment of all sums due is received by the Seller.
3. Gas and Diesel Oil
(a) Winter Grade gas/diesel oil is manufactured to a Cold Filter Plugging Point oil that reverts to -12°Celsius (known as winter grade) from November 1st to March 15th and as such is suitable for use in normal winter conditions in Ireland provided it is not mixed with any oil not meeting the same specifications. The Cold Filter Plugging Point oil reverts to -4°Celsius (known as summer grade) from March 16th to October 31st and as such is suitable for use in normal summer conditions in Ireland provided it is not mixed with any oil not meeting the same specifications. Buyers should take precautions to protect the equipment in which the oil is stored against severe weather conditions. Precautions, without limiting the generality of the foregoing, should include keeping the equipment/piping in good condition, cleaned and suitably protected in the case of motor vehicles keeping them garaged when not in use.
(b) The Seller’s other usual terms and conditions of sale apply and acceptance of goods will be treated as an acceptance of the Seller’s Conditions.
(c) The Oil is for the Buyer’s own use and not for resale and the Buyer undertakes that the oil will not be used as fuel in mechanically propelled vehicles constructed or adapted for use on roads in contravention of the Finance Act 1935 and/or amending legislation.
4. Diesel/Motor Fuel for Road Vehicles to Commercial Customers
(a) Diesel/Motor Fuel for road vehicles is sold exclusively for the Buyer’s own use in the Buyer’s own commercially licensed vehicles hired or worked by the Buyer in the course of the Buyer’s business and the Buyer undertakes not to sell or dispose of any of it to any other Company, firm or person.

By signing this mandate form, you authorise Glen Fuel Services Ltd to send instructions to your bank to debit your account and that your bank debits your account. As part of your rights, you are entitled to a refund from your bank under the terms and conditions of your agreement with your bank. A refund must be claimed within eight weeks starting from the date on which your account was debited. Your rights are explained in a statement that you can obtain from your bank.

I/We confirm that the information given on this application form and direct debit mandate is true and correct. I/We agree and understand that Glen Fuel Services Ltd. is not obliged to accept this application nor to give any reason for refusing the same, nor to enter into any correspondence in regard thereto.
